NIKE, Inc. has filed a request for extension of time to file opposition with the USPTO as its first step towards opposing WWE’s application to register the mark “Just Bring It”. The request was filed on January 28, 2016, the last day of the 30-day publication period for the application. NIKE will now have an additional 30 days to file its formal opposition to the application.
The application to register “Just Bring It” was filed by WWE on October 18, 2014.
It is interesting to note that the USPTO examiner that reviewed the application and ultimately approved it for publication “found no conflicting marks that would bar registration”. NIKE obviously disagrees with the examiner. If “Just Bring It” is found to be confusingly similar to any of NIKE’s various registrations and other pending applications for “Just Do It”, then registration will be barred.
